So, marginal employment does not qualify as substantial gainful employment. What does that mean? In this regulation, they give you a couple of examples of what qualifies, and one of those I want to talk to you about is marginal employment based on limited earnings. They go on in this regulation to say that marginal employment shall be deemed to exist when a veteran's earned annual income does not exceed the amount established by the Department of Commerce and the Bureau of Census within the Commerce Department. Basically, if you are below the poverty threshold, you can still earn money and draw your full tdiu benefits. This raises the next question: how much can I earn? That's what everybody wants to know. And that depends on how many people there are in your family.
